2.1. Service description. The Angland allows Users to access and play the fishing gameplay mode through an in-App Virtual Items known as a tackle and capsules, which functions as the User’s primary fishing tool. Each User must have an active tackle item assigned to their account to initiate fishing actions within the Angland.

 

All gameplay functionality is designed and controlled by the Company within the Angland environment. External platforms may interact with the Angland only to the extent expressly permitted and never to provide gameplay features.

 

The Company may, at its sole discretion and without prior notice, develop, deploy, or require the installation of patches, updates, upgrades, modifications, maintenance releases, content additions, feature enhancements, balance adjustments, or other changes to the Angland (“Updates”). Updates may be provided for purposes including, but not limited to, improving gameplay, enhancing security, ensuring regulatory or platform compliance, correcting errors, introducing new features or content, modifying existing mechanics, or removing features that are no longer supported.

 

The Company will inform Users of any material modifications to the Angland, these Terms, or related Services by publishing a notice within the in-App “News” section and by sending an email to the address associated with the User’s account. Continued use of the Angland following the effective date of such modifications shall constitute the User’s acceptance of the updated terms, unless otherwise required by applicable law.

 

The User acknowledges and agrees that:

• updates may be mandatory in order to continue accessing or using the Angland or certain features;

• the Company is not obligated to maintain or support any particular version of the Angland;

• the Angland and its features may change, expand, restrict, or be discontinued as a result of an Update; and

• the Company shall not be liable for any disruption, loss of progress, incompatibility, or other effects resulting from any Update, provided that such Update is implemented in good faith and in accordance with applicable law.

 

Nothing in these Terms shall be construed as obligating the Company to continue producing, maintaining, or distributing any particular feature, content, or component of the Angland, including in-App Virtual Items, mechanics, or integrations with external technologies.

 

2.2. In-App Virtual items. Different Virtual Items may provide different characteristics or performance effects within the Angland, such as varied fishing speed, efficiency, or utility, as designed by the Company.

 

All characteristics, effects, and attributes of Virtual Items used in the Angland are defined and provided entirely within the Angland. External digital collectibles, including NFTs, may link to corresponding Virtual Items, but do not generate or introduce new attributes beyond those already defined by the Angland. The Company remains solely responsible for determining, modifying, or balancing all Virtual Item attributes within the Angland.

 

All Virtual Items, whether linked to an NFT, or otherwise made available, are licensed to the User solely for use within the Angland, have no monetary value, and do not confer any ownership rights in the Angland or the Company.

 

The use, linking, and management of NFT-based Virtual Items is additionally governed by the NFTs terms of use. 

 

The Company may modify, balance, restrict, or discontinue any Virtual Item or NFT-related functionality at its discretion to ensure compliance, maintain gameplay integrity, or address technical considerations.

 

2.3. Capsule Virtual Item. Certain Virtual Items may function as containers or capsules that, when revealed, result in the issuance of another NFT with randomly determined attributes or rarity. Users acknowledge that any randomized outcome is governed solely by Smart Contract logic and predefined probability distributions.

 

The Company does not guarantee any specific result, rarity tier, or attribute outcome from the opening or revealing such Virtual Items. Users acquire such Virtual Items with full understanding that outcomes are uncertain and may result in NFTs of lower or higher rarity.

 

Mentioned Virtual Items are intended solely as gameplay mechanics and are not games of chance for money or equivalents. No fiat or monetary prize is awarded through capsule reveals.

 

2.4. In-App Purchases. The Angland may offer optional in-App purchases, including Virtual Items or other digital content. All purchases made within the Angland must be processed through the App Store or Google Play or the native in-game utility token $FISH in accordance with the applicable platform’s billing rules.

 

Users may, however, acquire certain blockchain-based digital assets, such as NFTs, through lawful third-party platforms that support payments in ETH or other cryptocurrencies. Such external purchases occur entirely outside the App and are not processed, managed, or facilitated by the Company. External purchases do not grant any in-App purchase rights, do not replace IAP functionality, and do not affect or bypass the platform's required billing mechanisms.

All IAP transactions are final and governed by the refund policies of the respective platform operator. The Company does not control and is not responsible for any fees, exchange rates, wallet services, or risks associated with blockchain transactions conducted outside the App.

You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. The Company may revise the pricing for the Virtual Items or any other Service of Angland at any time.

 

Any in-App purchases of consumable currency or Virtual Items will not expire and can be restored on authorized devices.

 

2.5. Refund policy. Except as provided for in cases where an error in the purchase process or a processing failure occurs, all transactions for in-game purchases are final and non-refundable. Furthermore, while Users may purchase Virtual items for personal use within the Angland, such assets may not be traded, resold, or otherwise transferred to other users.

 

You acknowledge that the Company is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused Virtual items when an account is closed, whether such closure was voluntary or involuntary.

 

If our investigation determines that a technical failure on the part of Angland prevented the successful delivery of a purchased Virtual item, we will, at our option: (i) take all necessary measures to deliver the Virtual item successfully, or (ii) where it is feasible and appropriate, provide a refund or credit equal to the value of the undelivered Virtual item.

 

With respect to any in-App purchases made through the App Store or Google Play billing systems, the Company complies with the respective refund, cancellation, and consumer-protection policies of Apple and Google, as applicable in the User’s jurisdiction. All requests, inquiries, or claims relating to refunds for In-App purchases shall be handled exclusively in accordance with the procedures and conditions established by the relevant platform provider, and the Company shall not provide additional refunds or remedies beyond those required under the applicable App Store or Google Play terms.

 

2.6. Account. To access and use Angland, you must first register and maintain a valid Account. You must also have access to a supported mobile device and a stable internet connection to engage with the Angland. The Angland does not support the use of rooted, jailbroken, or otherwise modified devices. Unsupported devices may be restricted from accessing the Angland or certain functionalities.

 

You may register an Account by linking a supported third-party login method or by using other methods provided in the Angland. You are solely responsible for maintaining the confidentiality of your Account credentials and must not share your password or login details with any third party. You agree to notify us immediately if you become aware of any unauthorized access to or use of your Account. While we take reasonable steps to protect Users Accounts security, you remain fully responsible for all activity conducted under your Account, whether or not such activity was authorized by you. The Company disclaims any liability for damages or losses incurred as a result of unauthorized Account access.

 

The User may delete their Angland Account at any time by using the in-App account-management tools or by submitting a deletion request through the designated support channels. Deleting the Angland account will result in the permanent removal or anonymisation of the User’s in-App data in accordance with applicable data-protection laws and the Privacy Policy. The User may also delete the App from their mobile device at any time, understanding that such deletion does not automatically terminate the User’s account unless the User additionally submits an account-deletion request.

 

2.7. Account suspension or termination. We reserve the right to suspend or permanently terminate your Account and restrict access to the Angland or its Services at our sole discretion and without prior notice, including but not limited to the following circumstances:
(a) your violation of these Terms or any applicable law;
(b) suspected fraud, cheating, or exploitation of any Angland feature or Content; or
(c) engagement in or association with unlawful activity through your Account.

In addition, if your Account remains inactive for an extended period of time, we may notify you through in-game communications or other appropriate means prior to initiating termination of your Account for inactivity.

 

You may choose to terminate your Account at any time by submitting a request through our official support channels within the Angland. Upon termination of your Account - whether by you or by the Company - the following sections of these Terms shall remain in effect: Intellectual Property, Indemnification, Disclaimers and Limitation of Liability, Indemnification, Governing Law, Jurisdiction, and Dispute Resolution.

 

2.8. Third-Party Integrations. Angland may integrate with and rely on certain third-party services to support its functionality and performance.

 

By using the Angland, you acknowledge and agree that your data may be processed by these third-party service providers in accordance with their respective terms of service and privacy policies. We do not control and are not responsible for the content, privacy practices, or operations of such third parties. However, we take reasonable measures to ensure that any data shared with these providers is limited to what is necessary for the performance of the Angland and is handled in accordance with applicable data protection laws and our Privacy Policy.

 

Your use of the Angland constitutes your consent to such third-party integrations, and you understand that the Company disclaims any liability arising from the acts or omissions of these third-party providers.

 

2.9. Acceptable Use Policy. By using the Angland, you agree to adhere to the following acceptable use guidelines. You agree to use Angland in compliance with these Terms and all applicable laws and regulations. The following actions are strictly prohibited and constitute a material breach of these Terms:

- Lawful Use: You shall use the Angland exclusively for lawful purposes and in full compliance with these Terms, as well as all applicable local, state, national, and international laws and regulations.

- Preservation of System Integrity: You agree not to engage in any activity that may harm, disable, overburden, or otherwise impair the Angland’s infrastructure or its operation. This includes, but is not limited to, initiating any form of denial-of-service attack, distributing malware, or otherwise interfering with the performance of the Angland.

- Unauthorized Access Prohibition: You shall not attempt to gain unauthorized access to the Angland, its systems, networks, or any data or resources that you are not expressly permitted to access. Any such attempts may result in immediate legal actions.

- Compliance with Guidelines: You agree to comply with all usage guidelines, restrictions, and instructions provided by the Company from time to time, whether these are communicated via these Terms or through other official channels.

- No Endorsement and Preservation of Proprietary Notices: You agree not to imply that any of your statements or actions are endorsed by the Company unless expressly authorized, nor may you remove, alter, or obscure any copyright, trademark, or other proprietary notices appearing on the Angland or related materials.

- Investment Fraud: You are prohibited from promoting fraudulent schemes (e.g., "pump-and-dump" crypto scams, fake airdrops) using Services on Angland.

- Money Laundering: You are prohibited from using Angland’s to obfuscate illicit fund flows or evade sanctions (e.g., OFAC-prohibited jurisdictions).

- No Gambling: You may not wager, bet, or stake any NFTs, Virtual Items, or currency within Angland in exchange for the chance to win prizes of real-world value.

- Phishing or other types of scam: You are prohibited from creating fake websites, emails, or social media accounts mimicking Angland;

- Scraping Prohibition: You are strictly prohibited from using bots, crawlers, scripts, or other automated tools to extract, collect, or replicate data from Angland without prior written consent. This includes bypassing technical safeguards or overloading our infrastructure. Violations may result in immediate termination of access and legal action under applicable laws.

- Cheating or Exploiting Bugs: You are prohibited from using, creating, or distributing exploits, cheats, unauthorized automation, or manipulating the Angland in any way that provides an unfair advantage or disrupts gameplay.

- Account Sharing or Selling: You are prohibited from transferring, renting, sharing, or selling accounts or account credentials to any third party is strictly prohibited.

- Toxic Behavior and Harassment: You are prohibited from engaging in abusive, threatening, harassing, discriminatory, or otherwise harmful behavior towards other users, moderators, or representatives of the Angland.

- Impersonation: You are prohibited from falsely representing yourself as another person, entity, developer, or representative of the Angland.

- Farming or Botting: You are prohibited from engaging in automated gameplay (botting), repetitive tasks for financial gain (farming), or other activity intended to manipulate the in-game economy.

- Exploiting Economic Systems: You are prohibited from manipulating the in-game currency, marketplaces, or reward mechanisms in a manner that violates the intended gameplay balance or economic fairness.

- Posting Inappropriate Content: You are prohibited from sharing or publishing any content that is illegal, obscene, sexually explicit, defamatory, hateful, or otherwise objectionable within the Angland or associated platforms.

- Circumventing Suspensions or Bans: You are prohibited from attempting to bypass, evade, or otherwise circumvent any suspension, ban, or other enforcement actions applied to your account or access.

 

 Failure to comply with these acceptable use provisions may result in:

• Temporary ban, namely restriction of the User's access to Angland or temporary suspension of Account;

• Immediate suspension or termination of your access to Angland;

• Technical measures (e.g., IP blocking, bot detection) to prevent further violations;

• Disclosure of your identity and activities to law enforcement, regulatory agencies, or harmed third parties.

• Civil claims for losses caused to the Company or third parties;

• Criminal prosecution under applicable laws;

• Regulatory penalties for breaches of data protection, financial, or sanctions laws.

 

The Company reserves the right to recover all reasonable costs incurred in enforcing these Terms, including investigation fees, legal expenses, and damages.
